CONSERVATION EASEMENTS
Conservation easements are legal written agreements between a landowner and a land trust that outline the rights and restrictions of both parties. The landowner continues to own and manage the land, and the trust protects the land’s conservation value. Landowners’ benefits are twofold: at the same time they preserve their land, they are also preserving their wealth through income tax deductions and estate tax reductions.
LAND DONATIONS
When you donate land to a land trust, the trust owns and conserves the land. As with conservation easements, landowners receive substantial income tax deductions and estate tax benefits. Donating land allows the landowner to avoid the capital gains taxes that may result from selling the property. Donating land is most appealing to people who do not have heirs, or whose heirs are not interested in protecting it; who wish to avoid the large capital gains taxes if they sell a highly appreciated property; who wish to reduce estate tax burdens; or who wish to hand over the responsibility of an ecologically valuable piece of land to someone else.
